The Snows of Khione Ballet Academy

AGREEMENT TO TERMS. These Terms and Conditions govern your access to and use of the website, programs, classes, performances, and services offered by The Snows of Khione Ballet Academy (“Academy,” “we,” “our,” or “us”). By accessing our website, enrolling in any program, attending classes, or participating in Academy activities, you agree to be bound by these Terms. If you do not agree, you should not use our services.
NATURE OF ORGANIZATION. The Snows of Khione Ballet Academy is a nonprofit organization based in the State of New York, dedicated to providing structured ballet training, artistic development, and performance opportunities. Participation in Academy programs is not a casual or drop-in service, but a commitment to a structured training environment and scheduled programming.
ELIGIBILITY AND ENROLLMENT. Enrollment in Academy programs is open to individuals who meet the age and training requirements specified for each division. For minors, enrollment must be completed by a parent or legal guardian who agrees to these Terms on behalf of the student. The Academy reserves the right to determine placement, adjust class levels, and deny or terminate enrollment at its discretion.
PROGRAM STRUCTURE AND PARTICIPATION. Programs are structured to support long-term development and performance readiness. Enrollment may include training, rehearsals, performances, and related activities. Participation requires consistent attendance, punctuality, and adherence to Academy standards. The Academy reserves the right to restrict participation or dismiss any student whose conduct, attendance, or behavior is deemed disruptive, unsafe, or inconsistent with the Academy’s expectations.
TUITION, FEES, AND PAYMENTS. Tuition and fees are required for participation and must be paid in accordance with the selected payment plan. By enrolling, you authorize the Academy to charge your designated payment method for all applicable fees. If installment payments are selected, charges will be processed on a recurring basis until the balance is paid in full. You agree to maintain valid payment information and to pay all amounts owed regardless of attendance. All payments are non-refundable unless otherwise required by law or expressly stated by the Academy. The Academy reserves the right to suspend participation or withhold services in the event of non-payment. Returned or declined payments may incur additional fees, and unpaid balances may be referred to collections.
REFUNDS, CREDITS, AND CANCELLATIONS. All tuition and fees are non-refundable. This includes, but is not limited to, withdrawals, absences, injuries, scheduling conflicts, or dissatisfaction with the program. In limited circumstances, such as Academy-initiated cancellations, the Academy may offer a credit toward future programming or, at its discretion, a refund. If programming is modified, rescheduled, or delivered in an alternative format due to circumstances beyond the Academy’s control, participation will continue in the adjusted format and no refunds will be issued. Credits may be granted at the Academy’s discretion.
PERFORMANCE PARTICIPATION. Participation in performances, including The Snows of Khione: Winter Kingdom, is contingent upon attendance, conduct, and readiness. The Academy reserves the right to assign roles, make casting decisions, and remove or reassign participants at any time. Performance opportunities, including principal roles such as Snow Ballerina or Naida’s Ushu, are not guaranteed and are awarded at the sole discretion of the Academy.
HEALTH AND SAFETY. Participation in dance and performance activities involves inherent risks, including the risk of physical injury or illness. By participating, you acknowledge and accept these risks. You agree to ensure that you or your child are physically able to participate and to notify the Academy of any medical conditions that may affect participation. Participants who are ill or injured should refrain from attending classes and activities. The Academy reserves the right to require medical clearance before allowing a participant to return. No refunds will be issued due to illness or injury.
WAIVER AND RELEASE OF LIABILITY. To the fullest extent permitted by law, you agree to release, waive, and hold harmless The Snows of Khione Ballet Academy, its directors, officers, instructors, staff, contractors, and affiliates from any and all claims, liabilities, damages, or expenses arising from participation in any Academy activity. This includes, but is not limited to, claims related to personal injury, illness, loss of property, or death, whether caused by negligence or otherwise. You agree not to bring any claim or legal action against the Academy arising from participation in its programs or use of its facilities.
MEDIA RELEASE AND LIKENESS RIGHTS. By enrolling in the Academy or participating in any of its programs, you grant The Snows of Khione Ballet Academy the irrevocable right and permission to photograph, film, record, and otherwise capture your or your child’s name, image, likeness, voice, and performance. You acknowledge and agree that these materials may be used, reproduced, edited, published, distributed, and displayed by the Academy in perpetuity for promotional, advertising, editorial, and commercial purposes across all media formats, including but not limited to print, digital, video, social media, and publications. You understand that no compensation will be provided for such use and waive any right to inspect or approve the final materials. You release the Academy from any claims arising from the use of such materials.
INTELLECTUAL PROPERTY. All content, materials, choreography, music, productions, branding, and creative works associated with The Snows of Khione Ballet Academy are the exclusive intellectual property of the Academy or its licensors. No content may be reproduced, recorded, distributed, or publicly displayed without prior written consent. Unauthorized recording of classes, rehearsals, or performances is strictly prohibited.
CODE OF CONDUCT. Participants are expected to maintain respectful and professional behavior at all times. Disruptive, unsafe, or inappropriate conduct may result in suspension or dismissal without refund. The Academy reserves sole discretion in determining whether conduct is acceptable.
INDEPENDENT CONTRACTORS. Instructors, choreographers, and other professionals engaged by the Academy may serve as independent contractors. Participation in Academy programs does not create any employment relationship between participants and the Academy or its staff.
THIRD-PARTY SERVICES. The Academy may collaborate with third parties for services such as photography, media, or event production. The Academy is not responsible for the actions or policies of third-party providers.
WEBSITE USE. By using the Academy’s website, you agree not to misuse the site, attempt to gain unauthorized access, or engage in any activity that disrupts its operation. All content on the website is protected by intellectual property laws.
LIMITATION OF LIABILITY. To the fullest extent permitted by law, the Academy shall not be liable for any indirect, incidental, special, or consequential damages arising from participation in its programs or use of its website or services.
INDEMNIFICATION. You agree to indemnify and hold harmless The Snows of Khione Ballet Academy from any claims, damages, or expenses arising from your use of the Academy’s services or your violation of these Terms.
GOVERNING LAW. These Terms shall be governed by and construed in accordance with the laws of the State of New York. Any disputes shall be resolved in the courts located within New York.
MODIFICATIONS. The Academy reserves the right to update or modify these Terms at any time. Continued use of the website or participation in programs constitutes acceptance of any changes.
